1. Handcrafted Product Authenticity

All headbands, do-rags, welding caps, and bandannas sold on this website are genuine, registered trademark creations of Marie's Famous Headbands®. Because each piece is individually hand-sewn, slight variations in embellishment and pattern alignment may occur, reflecting authentic American artisan craftsmanship.

2. Shipping & Delivery

• Retail Orders: Enjoy complimentary standard US shipping on all retail orders over $50.00. Orders under $50.00 ship for a flat $5.00 carrier fee.
• Dispatch Times: Orders typically ship within 1–2 business days via USPS Ground Advantage or UPS Ground with tracking.
• Wholesale Orders: Wholesale orders are subject to a strict 50-piece minimum order threshold and flat $15.00 carrier shipping.

3. Care & Washing Instructions

To preserve the rhinestone crystal embellishments and soft comfort-stretch fabric:

• Machine wash cold on gentle cycle or hand-wash gently with mild detergent.
• Do not wring, bleach, or place in a high-heat machine dryer.
• Hang dry or lay flat on a clean surface to air dry.

4. Returns & Exchanges

To report an issue or inquire about an exchange, please visit our Contact Page, email orders@mariesfamousheadbands.com, or call (361) 429-3287 with your order number. Due to the personal, handcrafted nature of our wearable hair accessories, items must be in original, unworn condition with original packaging. Return shipping postage is the responsibility of the purchaser unless the item arrived defective or damaged.

5. Crystals Guaranteed Craftsmanship Warranty

We stand behind our work: crystals guaranteed. If any heat-fused rhinestone crystal embellishment detaches due to a defect in materials or craftsmanship, contact us with your order number and a photograph of the item. We will gladly inspect, repair, or replace the item.

6. Wholesale Purchasing & Immediate Payment

Wholesale pricing ($8.50/unit) is reserved exclusively for approved retail businesses, hair salons, and licensed boutiques subject to a strict 50-piece minimum order requirement. Wholesale merchandise is intended strictly for authorized commercial resale. All wholesale orders must be paid in full immediately at checkout via PayPal (including debit/credit cards or PayPal balance) prior to order fulfillment and dispatch.

7. Payment Processing via PayPal

All retail and wholesale payments are processed exclusively and securely through PayPal. Customers may pay with their PayPal balance, linked bank account, major debit or credit cards (Visa, MasterCard, American Express, Discover), or mobile digital wallets processed through PayPal's tokenized gateway. Marie's Famous Headbands never captures or stores credit card numbers on its servers.

8. Texas Sales Tax & Tax-Exempt Resale Policy

Texas Deliveries: In accordance with Texas Tax Code and Comptroller Rule 3.303, Texas Sales Tax at the combined rate of 8.25% (6.25% State + 2.0% Corpus Christi / Nueces County local jurisdiction) is collected on retail products and applicable delivery charges for orders delivered within the State of Texas.

Out-of-State Deliveries: Orders shipped to destinations outside the State of Texas are not charged Texas sales tax. Customers remain responsible for complying with any applicable local or state use tax regulations in their home jurisdiction.

Wholesale Resale Exemption: Approved wholesale commercial partners purchasing merchandise for resale are processed strictly tax-exempt upon verification of an active state resale certificate and business tax identification number on file.

9. Governing Law & Texas Jurisdiction

These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any legal action, dispute, or proceeding arising under or relating to this website or purchases made herein shall be brought exclusively in the state or federal courts located in Nueces County, Texas.
